ELECTRICIANXCHANGE PTY LTD, ABN 90 623 004 795  (‘we’, ‘our’, ‘us’) owns and operates electricianXchange and the website www.electricianXchange.com.

These Terms and Conditions govern the use of the www.electricianXchange.com Online Platform Service ("the Service").

Please read this Agreement carefully. Your use of the Service will constitute your agreement to comply with these rules.

Calls recorded for quality assurance & training purposes: Please note that all calls made or received by the electricianXchange team will be recorded for quality assurance / training purposes. If you do not want the call to be recorded, please let us know at the start of each discussion.

Service: Our overriding objective is to allow a free, open, current, transparent labour market place for pre-dominantly the electrican trade (but other electrical workers also can use this as necessary) with electricianXchange as the introductory mechanism through which the two stakeholders, employer & jobseeker (permanent, sub-contract or casual) come together directly negotiating directly on dates, rates, conditions.

In the interests of maintaining an active Service, should a jobseeker or an employer not respond within a reasonable time, to a reach out by either party to the other, electricianXchange reserves the right to cancel the approach on your behalf replying on your behalf  - this being in the interests of having an active current market place for talent.

As its a free service to search, communicate, align and pre-qualify via the chats - no contact details such as name, contact number, email address, web site addresses are allowed in the chats. The employer upon paying a small fee gets the jobseeker's contact details and its through that where we can keep it free for jobseekers and at a manageable cost for employers.

If contact details are sent withint the chats (which we monitor daily) electricianXchange will unsubscribe the employer / jobseeker who does that, for not strictly following the terms and consiions upon which this service is being provided.

Access

The platform provides a range of services, which requires log on access.

Individual Subscriber

A person (who could be an A-Grade Electrician, an Electrical Apprentice or a person with an Electrical background) may register as an individual subscriber on the site & create their work availability profile, for the purposes of finding work whether the work needed is of a permanent, sub-contract or casual capacity. Upon registration, you will have a secure log on access including a password nominated by you.

Employer Subscriber

This will be a registered Electrical Contracting Company (REC) or a company capable of hiring A Grade Electricians / Electrical Apprentices / Electrical Workers. Employer Subscribers (herein called "employer") will require an employer account. A log on as an employer, will allow the employer to search for jobseekers whether these are on a permanent, sub-contract or casual capacity through the "Want Staff" option on the site. 

Terminology

“Subscriber” means all registered members of the Website, including members registered as an “employer”, "jobseeker", “corporation”, “body” (whether a body corporate or an unincorporated and includes for example an association), “partnership”, “joint venture”, “natural person”, “supplier” and electricianXchange itself as a party liaising with all of these stakeholders.

“Website” means this Website (www.electricianXchange.com) or any part of it.

Use of the Service by You

Individual: Your right to use the Service as an individual is personal to you. You may not authorise others to use the Service and you are responsible for your own use of the Service and for preventing unauthorised use by other persons except when it is the Administrator of the web site who has the deemed responsibility to liaise on your behalf if your account is not attended to within a reasonable time frame.

Employer: The employer's selected personnel who register on behalf of the company are responsible for their use of the Service and for preventing unauthorised use by other persons except when it is the Administrator of the web site who has the deemed responsibility to liaise on your behalf if your account is not attended to within a reasonable time frame.. Companies must ensure that user profiles are maintained and kept current.

For both Individual and Employer Subscribers: electricianXchange Pty Ltd owns all copyright and all other intellectual property rights on this site www.electricianXchange.com except information that is specifically provided and directly posted by the individual / employer. electricianXchange welcomes your use of this site provided that you respect all copyright, trademark and other propriety notices contained in the content. We advise that you may not copy or display for redistribution to third parties or for commercial purposes any portion of this site without express permission, unless that information has been specifically provided and directly posted by you as an individual or by you on behalf your Company.

All other information and material you supply or communicate to the Service is governed by these terms & conditions and in addition by our Privacy Policy, which forms a part of this Agreement.

Jobseeker: Jobseeker means an electrician, electrical apprentice or electrical worker looking for work, whether as an individual or as an employee of a company looking to be sub-contracted out.

Labour Hire Licensing Legislation

In Victoria and in some other States such as Queensland within Australia there is a Labour Licensing legislation introduced which lays specific conditions under which staff / labour can be sub-contracted out. 

Each employer must takes its own advice as to whether this legislation applies to them.

electricianXchange takes no responsibility in relation to this, given it is merely the introduction platform through which a willing employer and a willing jobseeker come together for the purposes of working together.

Reference checks undertaken

Every jobseeker whether as an individual or as an employee being sub-contracted out by an employer, and whether in a permanent, sub-contract, casual or part time capacity agree to have reference checks completed before employment commences - should the employer request this of electricianXchange.

By agreeing to these Terms & Conditions, the jobseeker of every variation as outlined above, gives permission to electricianXchange and its staff or those instructed by electricianXchange's staff to undertake the reference checks on the jobseeker's behalf and to contact the referees listed within the jobseeker's account profile to conduct the reference checks - should the employer or prospective employer request this. Some examples of the type of questions posed by the reference checkers can be located here and you agree to this reference checking as an integral part of the electricianXchange process.

Employers must ask electricianXchange to initiate the reference checking process. As electricianxchange is an introductory platform, the employer & the jobseeker after introduction may decide not to go ahead (upon which a credit note on request is issued). This is the reason why reference checks are not automatically initiated & will need to be requested by the employer to electricianXchange.

Should things not work out between the prospective employer and the prospective jobseeker for any reason, the employer may ask electricianXchange for a Credit Note. For our credit note policy, please see our Costs & Guarantees section.

General

We derive our information from individuals or employers who register on our site.

While we will take all care; responsibility rests with the individuals or the employer registering and posting the information at all times. This includes information about the work availability posts made on the website, the replies made back and forth between the employer and the jobseeker plus all other information entered into the website by either the jobseeker or the employer. electricianXchange is acting merely as the introduction platform through which these two stakeholders, the employer and the jobseeker come together, with the specific terms and conditions of hire determined seperately and independantly between the employer and the jobseeker after the introduction by electricianXchange has been made.

In using the web site, you warrant that the content, material or information that you post or upload to the website will not be fraudulent, defamatory and will not infringe the intellectual property rights, confidentiality rights, or privacy rights of any person or any applicable law.

Where the content, material or information on this website or any linked website contains opinions or judgments of third parties, we do not purport to endorse the contents of that opinion or advice, nor the accuracy or reliability of that opinion or advice.

electricianXchange will after the introduction of the two stakeholders (employer and jobseeker) and upon a request by the peopspective employer, provide a set of reference checks as a starting point, not as a final determination of quality of either party. electricianXchange cannot be held responsible for the reference checks done with the employer and the jobseeker being responsible for their own independant checks, before commencing work together.

Termination of Access

Access to this Website to either the employer or the jobseeker may be terminated at any time by us without notice if the terms & conditions or the philosophy this site has been put together for, is not followed.

Privacy

electricianXchange has a strong privacy policy relating to all information that you provide through this web site and we will take all reasonable steps to prevent any data being inappropriately released or misused. Please see our Privacy Policy listed separately and which forms a part of these terms and conditions.

Changes to Terms and Conditions

We may change these terms and conditions at any time. Each time you use the Service you are agreeing to the terms and conditions applicable at that time. We provide a link to these Terms and Conditions at the bottom of every page of the website. You agree to the terms and conditions as applicable at any time.

Jurisdiction

The laws of Australia apply to these Terms and Conditions. Any dispute with electricianXchange arising in relation to these Terms and Conditions will be resolved in accordance with Australian law with the jurisdiction of New South Wales prevailing.

Fraudulent Activity

From time to time, despite our best intentions and processes, illegitimate claims of being a qualified electrician, apprentice or REC / Employer may be entered by either of these parties. While electricianXchange will do everything it can, to provide a platform which allows work related connectivity between employer & jobseeker, it cannot totally eliminate the possibility that despite the best intent, will not happen. 

electricianXchange will endeavour to ensure that all information is accurate and that is why we have a reference checking component after introductions are made. However, we cannot completely eliminate this risk.

Hence after introductions by electricianXchange, it is your responsibility to undertake your own reference & other checks formulating a written, defined labour / employment agreement between both parties - employer & jobseeker.

Should after the introduction fee being paid and our reference checks completed, you find within 48 hours of the person starting work, information which would cause you to change your mind regarding working with each other, you are entitled to ask electricianXchange for a Credit Note for the fee paid to electricianXchange as an employer, which you can then use for a subsequent search by you through electricianXchange. For 1st year apprentices (given few technical skills to assess on) we will extend the credit note policy for up to 4 weeks after the individual starts work. Besides this credit note issued to be able to select someone else, you agree that electricianXchange is not liable for any other payment or damages.

Fees charged by electricianXchange

There is an introduction fee charged to the employer.

There is no fee charged to the jobseeker. 

The fee charged to the employer is a flat fee which is listed on the website and which may change from time to time.

Refund Policy

Should, despite our best efforts including the reference check, you are not satisfied with the introduction made, electricianXchange will provide a credit note for the full amount paid to the fee paying employer.

This however will be only valid should it be within 48 hours after the jobseeker commences work.

For 1st year apprentices, given few skills to asses them on, electricianXchange will extend the credit note availability for up to 4 weeks after the individual starts work.

1. INTRODUCTION
We manage personal information in accordance with the Privacy Act 1988 and Australian Privacy Principles. This policy applies to information collected by electricianXchange via the website www.electricianXchange.com here from referred to as “Company”.

We only collect information that is reasonably necessary for the proper performance of our activities or functions. We do not collect personal information just because we think it could be useful at some future stage if we have no present need for it. We may decline to collect unsolicited personal information from or about you and take steps to purge it from our systems. By following the links in this document, you will be able to find out how we manage your personal information as an APP Entity under the Australian Privacy Principles (APPs).

2. WHAT INFORMATION DO WE COLLECT?

Company collects the personal information needed to provide Company Services and for our business operations. If you choose not to provide certain personal information to us, we may not be able to provide you with the services you require. The following are the main types of personal information collected by Company and the main purposes for which they are collected.

Registration Information is the information you provide to Company in the course of registering for a Company Service, for example, to create an account, become a job subscriber or become an employer. Registration Information includes, for example, name, email address, a password, a user name to protect your privacy and a mobile number. It includes information which you provide to Company in the course of that relationship.

Activity Information – cookies and other technologies. When you access and interact with the Company Services, we may collect certain information about those visits. For example, in order to permit your connection to the Company Services, our servers receive and record information about your computer, device, and browser, including potentially your IP address, browser type, and other software or hardware information. If you access the Company Services from a mobile or other device, we may collect a unique device identifier assigned to that device, geolocation data, or other transactional information from that device.

Cookies and other tracking technologies (such as browser cookies and local storage, pixel beacons, and Adobe Flash technology including cookies) are comprised of small bits of data or code that often include a de-identified or anonymous unique identifier. Third parties that support the Company Services by providing services, such as allowing you to share content or tracking aggregate Company Services usage statistics, may also use these technologies to collect similar information. Company does not control these third-party technologies and their use is governed by the privacy policies of those third parties using such technologies.

3. HOW DO WE USE YOUR INFORMATION?

We use the information we collect from and about you to provide the Company Services and features to you, including: to measure and improve those Company Services and features; to improve your experience with both online and off-line Company Services by delivering content Company believes you are likely to find relevant and interesting; to provide you with customer support and to respond to inquiries. When you are not reasonably identifiable in relation to the information collected from or about you, we may use that information for any purpose or share it with third parties. We may also de-identify the information we collect about you so that we can use and disclose it without using or revealing any personal information about you.

We use the information we collect from and about you for these additional purposes:

To provide Company Services to you. Company will use your information to provide Company Services to you, to fulfil administrative functions associated with these services (for example billing, credit and account management). We may also use your information to improve Company Services including through research and data analysis by us and our service providers. We may use and disclose your personal information in other ways expressly disclosed at the point of collection.

To deliver relevant advertisements and content. Company and our advertisers may at a subsequent stage use the information we collect from and about you to deliver relevant ads and content to you when you use the Company Services.

To contact you. Company will periodically send emails or SMS's to inform you about your progress with an introduction via electricianXchange to an employer or jobseeker or may send promotional material or notifications which it believes might be of interest to you. Promotional materials may include invitations to participate in various activities or special offers.

To share with our Company Affiliates. Company may share your information with Company’s related companies within Australia. Users who visit our related companies’ services should still refer to their separate privacy policies, which may differ in some respects from this Privacy Policy. Where we share your information with our related companies, they may use your information in the same way as we can under this Privacy Policy.

To protect the rights of Company and others. There may be instances when Company may disclose your information, including situations where Company has a good faith belief that such disclosure is necessary in order to: (i) protect, enforce, or defend the legal rights, privacy, safety, or property of Company, our related companies or their employees, agents and contractors (including enforcement of our agreements and our terms of use); (ii) protect the safety, privacy, and security of users of the Company Services or members of the public; (iii) protect against fraud or for risk management purposes; (iv) comply with the law or legal process in any country; or (v) respond to requests from public and government authorities.

4. HOW DO WE PROTECT YOUR INFORMATION?

Company uses commercially reasonable administrative, technical, personnel to safeguard information in its possession against loss, theft and unauthorized use, disclosure or modification. However, no one can guarantee the complete safety of your information.

5. HOW CAN YOU ACCESS YOUR INFORMATION?

If you would like to access, review, correct or update your personal information, you may contact us as outlined in section 7 of this policy. In your request, please include your email address, name, address, and telephone number and specify clearly what information you would like to access, review, correct or update. We will try to respond to your request as soon as reasonably practicable. If we deny access in any circumstances we will generally tell you why.

6. HOW CAN YOU OPT OUT?

If you want to stop receiving promotional materials, you can change your account settings or follow the unsubscribe instructions at the bottom of each email.

Please note that all calls made or received by the electricianXchange team will be recorded for quality assurance / training purposes. If you do not want the call to be recorded, please let us know.

Updates to Privacy Policy. Company may modify this Privacy Policy at any time. Please look at the Last Updated date at the top of this Privacy Policy to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Company Services. If the changes affect any agreement between us, you will be entitled to terminate our agreement if those changes are not acceptable to you, on reasonable grounds.

Location of Data. Some of the Company Services are hosted in and managed outside of Australia and in dealing with Company, you consent to having any personal information accessible from or transmitted outside of Australia.

Linked Services. The Company Services may also be linked to sites operated by unaffiliated companies, and may carry advertisements or offer content, functionality, games, newsletters, competitions or applications developed and maintained by unaffiliated companies. Company is not responsible for the privacy practices of unaffiliated companies, and once you leave the Company Services or click an advertisement you should check the applicable privacy policy of the other service.

Collection of Personal Financial Information by a Payment Service. In some cases, we may use an unaffiliated payment service to allow you to purchase a product or make payments (“Payment Service”). If you wish to purchase a product or make a payment using a Payment Service, you will be directed to a Payment Service webpage. Any information that you provide to a Payment Service will be subject to the applicable Payment Service's privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, any Payment Service's use of information collected through any Payment Service.

Data Retention. We will retain your information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law.

Remember that even after you cancel your account, copies of some information from your account may remain viewable in some circumstances where, for example, you have shared information with social media or other services. Because of the nature of caching technology, your account may not be instantly inaccessible to others. We may also retain backup information related to your account on our servers for some time after cancelation for fraud detection or to comply with applicable law or our internal security or other policies. We do not always completely remove or delete all of your information for a number of reasons including due to technical and systems constraints, contractual, financial or legal requirements.

Sensitive Information. We ask that you not send us, and you not disclose, any sensitive personal information (such as information related to racial or ethnic origin, religion or other beliefs, health, criminal background or trade union membership) on or through the Company Services or otherwise. If, contrary to this request, you do provide any sensitive information, in doing so you consent to us collecting and handling that information in accordance with this Privacy Policy.

Complaint. If you think we have breached the Privacy Act or other applicable privacy laws, you may complain to us by contacting us as outlined in section 8 below. When you contact us, please include your email address, name, address, and telephone number and clearly describe your complaint. We will need to share your information with others who can assist in responding to your complaint. We will respond to your complaint as soon as reasonably practicable and in any event within 5 business days, by making contact with you to inform you whether we have accepted your complaint, need further information or do not think we are in breach. We will also let you know the next steps in resolving your complaint. If you are not satisfied with our response to your complaint, or at any time, you may refer your complaint to the Office of the Australian Information Commissioner (www.oaic.gov.au).
